The Icelandic Transport Authority, SGS, ruled in two different cases recently that the airline Hi Fly Ltd. was to pay damages of 400 Euros to each of five individuals, roughly ISK 58,000 kronas, for the cancellation of Niceair flights between April 10-11, and pay the airfare of the individuals who had to buy new tickets from other companies.

Niceair filed for bankruptcy on May 23, but Hi Fly was the airline on behalf of Niceair, which sold the tickets. The SGS rulings therefore mean that the passengers are entitled to compensation and reimbursement of air fares from Hi Fly, not Niceair.

More complaints on the table

SGS reports in response to Morgunblaðið that since Hi Fly was the company that had the operating license in the flights covered by the rulings, Hi Fly is responsible for the rights of passengers who had booked flights under the laws of the air and regulations on passenger rights.

SGS has more complaints on their table involving Hi Fly Ltd, so more people are expected to be compensated and their air fares paid. “The rulings of the Icelandic Transport Agency have legal effect only against the parties to the case, although the rulings certainly have a precedent in cases involving the same flight or in similar cases,” SGS stated.
